Terms of Service
Please read these terms carefully before using the Hikary services.
1. General Provisions
This document establishes the terms and conditions for using the Hikary mobile application and the website hikary.ro (hereinafter collectively referred to as the "Platform"), provided and administered by a natural person (the "Administrator").
The purpose of this document is to regulate the legal relationship between the Administrator and any person who accesses or uses the Platform (the "User"), regardless of the device used (mobile phone, tablet, computer, etc.).
By accessing and using the Platform, the User confirms that they have read, understood, and fully and unconditionally accepted these Terms and Conditions, as well as any subsequent updates thereto.
If the User does not agree, in whole or in part, with any of the provisions of this document, they must immediately cease using the Platform and uninstall the Hikary application.
The Administrator reserves the right to modify this document at any time, without prior notice, by publishing the new version on the hikary.ro website or in the "Terms and Conditions" section of the application. Modifications become effective upon publication.
The User is responsible for periodically checking the updated version of the document, since continued use of the Platform after the date of publication of the changes constitutes tacit acceptance of them.
The Hikary Platform has an exclusively informative and organizational purpose. It allows Users to add information about their own vehicles, associated documents, expenses, reviews, and other data relevant to the efficient management of their personal vehicle.
The website hikary.ro currently serves as a landing page for the application, without registration, collection, or direct processing functionalities for personal data, except for those necessary for statistics and the technical operation of the site (for example, essential cookies).
This document is governed by Romanian law and complies with general data protection principles and consumer rights.

3. Purpose and Scope
This User Agreement (hereinafter referred to as the 'Agreement') governs how individuals may access and use the Hikary Platform, which includes the mobile application available for Android and/or iOS devices, as well as the hikary.ro website. The platform is designed to create an intuitive, secure, and personalized digital environment that allows users to efficiently organize information related to their own vehicles.
The main purpose of the Hikary application is to simplify the management and tracking of personal vehicle data, so that users can centralize all important information in one place. Through the application, users can:
- add one or more vehicles to their personal profile along with relevant details (model, year, mileage, etc.);
- upload, save, and manage vehicle documents, such as RCA insurance, technical inspection certificates, vignettes, ownership documents, and other essential files;
- record ongoing expenses and maintenance history (fuel, service, repairs, taxes, parts, etc.);
- evaluate the performance, reliability, and maintenance costs of the vehicle using an internal rating system;
- receive notifications, reminders, and automated statistics regarding recorded documents or expenses (feature under development).
The Hikary application is intended exclusively for personal, non-commercial use. The platform does not act as an intermediary between users and does not provide the possibility to sell, buy, promote, or exchange goods and services. Any information entered into the application is stored privately and is intended only for the user who added it. The Administrator does not publish, distribute, or monetize this data for commercial purposes without the user's explicit consent.
The user understands and agrees that the Hikary Platform is purely for informational and organizational purposes. The application does not replace professional advice or authorized services in areas such as mechanics, insurance, accounting, taxation, or legal consulting. Decisions made by the user based on information entered into the application are fully assumed by the user, and the Administrator cannot be held liable for any financial, technical, or legal consequences resulting from the use of the application.
The platform may be used by any individual who is at least 16 years old, has the legal capacity to enter into a civil agreement, and has access to a compatible device connected to the internet. By creating an account, the user explicitly confirms that they meet these conditions and that the information provided is true, accurate, and up-to-date.
The Administrator reserves the right to modify, update, or develop the application at any time, depending on technical needs, security requirements, or user feedback. These changes may include adding new functionalities, optimizing existing ones, adjusting the graphical interface, modifying the way technical data is collected, or integrating third-party services. All updates will be published on hikary.ro or in the corresponding section of the application, and the user is encouraged to check this information periodically.
The hikary.ro website currently serves as a presentation (landing) page for the application. Its purpose is to provide general information about the application's functionalities, illustrative screenshots, installation guides, and links to the official stores (Google Play and App Store). In the future, the website may include other sections, such as an informational blog, car maintenance articles, contact forms, or other informative pages, without changing its primary nature as an informational platform.
The Hikary Platform does not intentionally collect or store data that is not necessary for its operation. All data entered by users is for personal storage purposes and is not used for personalized advertising, marketing, or sharing with third parties, except in cases required by law or for protecting the technical infrastructure.
Access to the Platform is free, but the Administrator reserves the right to introduce additional optional services in the future, which may be paid (e.g., premium features, extended storage, or automatic backup). Introducing such services does not affect the rights of existing users, and the details regarding costs, conditions, and benefits will be clearly presented at the time of their launch.
This Agreement does not grant the user any ownership rights over the application, the 'Hikary' brand, graphic content, or source code. The user only receives a limited, personal, non-exclusive, and revocable license that allows them to use the application strictly for the purposes specified in this document and in accordance with applicable law.
If the Platform is used by persons who do not meet the age or legal capacity requirements, full responsibility lies with their legal representatives (parents, guardians, caregivers, etc.). The Administrator reserves the right to suspend or delete any suspicious account that does not meet these conditions.
This document applies uniformly to all users, regardless of the country or region from which they access the Platform. In case of discrepancies between different language versions of the terms and conditions, the Romanian version prevails.
All legal relationships, obligations, and rights arising from the use of the Platform are governed by Romanian law, in compliance with the principles established by European Union law.
4. Account Registration and Use
To access all features of the Hikary app, the user must create a personal account. Account creation requires entering a valid email address, setting a password, and, if applicable, confirming them via a verification code or a link sent by email. In certain versions of the app, authentication via third-party services (such as Google or Apple) may also be available, in which case some basic data (name, email, profile photo) may be automatically retrieved with the user's explicit consent.
The Hikary account is unique and personal, intended solely for the user's own use. Sharing the account, login data, or any information saved in the app with other people is strictly prohibited, regardless of their relationship with the account owner.
The user bears full responsibility for all activities performed in their account, as well as for maintaining the confidentiality of their login data. If the user suspects that a third party has accessed their account without permission, they must immediately change their password and notify the Administrator via the contact address available on hikary.ro.
Registration in the app is voluntary. However, some features may be limited or unavailable without authentication, such as saving vehicle data, car documents, or expenses. Users who do not wish to create an account can only access publicly available general information.
When creating an account, the user agrees to provide real, accurate, and complete information. The Administrator reserves the right to suspend or delete accounts that contain false, incomplete, or fraudulent data.
The Hikary account allows storing information about vehicles, documents, and personal expenses. All such data is entered exclusively by the user, and the Administrator assumes no responsibility for its accuracy, completeness, or timeliness. The user is solely responsible for the content saved in the app and for any consequences arising from errors, omissions, or incorrect data.
By creating an account, the user accepts that the data provided may be stored and processed by the Administrator to ensure the technical operation of the app, improve performance, provide technical support, and, where applicable, generate anonymous usage statistics. The Administrator undertakes not to share, sell, or transfer this data to third parties, except as required by law.
The user has the right to request the deletion of their account and all associated data at any time. The request can be made through the app or by sending a direct message to the official contact address. After confirmation, the data will be permanently deleted from the database within a reasonable period, except for information that must be retained by law (e.g., for cybersecurity purposes).
The Administrator has the right, without prior notice, to suspend or temporarily delete a user account in the following cases:
- there are reasonable suspicions of fraud, abuse, or unauthorized use;
- the account is used for illegal purposes or contrary to good morals;
- repeated violations of these Terms and Conditions are detected;
- attempts are made to manipulate, exploit, or damage the Platform's technical infrastructure.
In case of account suspension or deletion, all information, documents, and data entered by the user may be permanently removed from the system, with no possibility of recovery. The Administrator is not obliged to provide compensation, refunds, or damages for data lost as a result of such action.
Registering on the Platform does not create a professional relationship, partnership, agency, employment, or legal representation between the Administrator and the User. The relationship between the parties is strictly that of a digital service usage agreement under these Terms and Conditions.
In the future, the Administrator may introduce additional account levels (for example: premium accounts, fleet accounts, or shared family accounts), each with its own usage conditions. In such cases, changes will be announced transparently, and users will need to accept the new terms before activating the additional features.
The user acknowledges that, although Hikary provides a high level of security, no online application can guarantee absolute protection against cyberattacks. The Administrator makes all reasonable efforts to protect stored data but cannot be held liable for losses caused by external events such as hacking, network failures, server errors, or other causes beyond their control.
Registration and use of the app imply continuous acceptance of these terms, including future modifications, and accessing the Platform after any update constitutes a renewed confirmation of this agreement.
5. User Rights and Obligations
The user has the right to use the Hikary app and the hikary.ro website freely, personally, and non-commercially, under the conditions set forth in this document. By downloading, installing, or accessing the app, the user receives a limited, non-exclusive, revocable, and non-transferable license to use the Platform exclusively for the purposes set out in Chapter 3.
The user has the right to:
- create a personal account, manage it, and delete it at any time;
- enter, modify, or delete information regarding their own vehicles, associated documents, and related expenses;
- receive technical support from the Administrator, subject to availability;
- benefit from data protection in accordance with privacy and personal data laws;
- be informed about major changes to the app when these affect the use of their account.
The user agrees to use the Platform only for legal purposes, in accordance with applicable Romanian and European law, good morals, and the principles of fair use of online services.
The user is not allowed to: a) use the Hikary app for commercial activities, advertising, selling goods, services, or promoting third parties; b) distribute, copy, reproduce, modify, decompile, sell, resell, or exploit the app or its components in any way; c) use the app to collect data about other users or attempt to access restricted areas of the system; d) publish or store illegal, false, defamatory, obscene, discriminatory, threatening, misleading content, or content violating the rights of others; e) transmit malware, viruses, scripts, automated programs, or any other form of cyberattack that could affect the Platform; f) create multiple accounts to abuse the system, test vulnerabilities, or generate fake traffic; g) attempt to manipulate, modify, or disable security components of the app.
The user understands that all information entered in the app (vehicle data, expenses, documents, etc.) is created and controlled by them. The Administrator does not verify or guarantee the accuracy of such data, and the responsibility for content lies exclusively with the user.
If a user enters or distributes content that violates the law, the rights of others, or the rules established in this document, the Administrator has the right to:
- restrict access to that content;
- temporarily or permanently suspend the respective user's account;
- notify the competent authorities if necessary;
- permanently delete the respective data, with no possibility of recovery.
The user agrees not to claim compensation, damages, or losses from the Administrator for potential data loss, temporary app malfunctions, or errors caused by external factors (connection issues, software updates, server failures, cyberattacks, etc.).
The user is obliged to keep login information safe and not allow others to access their account. Any action performed through a user account is considered as carried out by that user, unless proven otherwise.
If the user notices errors, vulnerabilities, or suspicious behavior in the app, they are encouraged to report them via the official contact channels indicated on hikary.ro, contributing to improving and securing the Platform.
The user is obliged to respect the intellectual property rights of the Administrator and other third parties, including rights to graphics, text, interface design, logo, name, and other distinctive elements associated with the Hikary app.
If a user causes damage to the app, other users, or the Administrator (through fraudulent, technical, or legal actions), they may be held personally liable for full repair of the damage in accordance with applicable law.
The user has the right to withdraw consent regarding the use of the app at any time by uninstalling it or deleting their account, without justification. Withdrawal of consent does not affect the legality of prior use.
If the app includes optional feedback, rating, or comment functionalities, the user is obliged to use these functions respectfully and constructively, without offensive language, spam, or harming the dignity of others.
The Administrator reserves the right to limit, suspend, or block access to any user who repeatedly violates these obligations, without being obliged to justify the decision or provide compensation.
When using the Platform, the user must keep in mind that Hikary is a digital support tool and not a certified archiving, legal, technical, or financial advisory service. Therefore, the user must keep backup copies of important documents and not rely solely on the app for the unique storage of essential information.
6. Rights and Obligations of the Administrator
The Administrator is the natural person who owns the rights to the Hikary app and the hikary.ro website, being responsible for the technical operation, security, and updating of the Platform, as well as compliance with applicable legislation.
The Administrator commits to make all reasonable efforts to ensure that the Platform operates correctly, stably, and securely, providing users with a pleasant and reliable experience. However, given the digital nature of the service, the Administrator cannot guarantee uninterrupted or error-free operation of the app, as there may be external factors beyond their control (e.g., network failures, system errors, operating system updates, cyberattacks, etc.).
The Administrator has the right to modify, suspend, limit, or temporarily interrupt access to the Platform, in whole or in part, in the following cases:
- maintenance, system updates, or improvements;
- technical or cybersecurity needs;
- unforeseen situations that may affect the proper functioning of the application;
- legal, administrative requirements, or compliance with app store policies (Google Play, App Store).
The Administrator has the right to periodically introduce new functionalities in the app or modify its presentation and interaction mode to improve the service and adapt it to user needs. Any significant change will be communicated in the app or on hikary.ro, and continued use of the Platform after updates constitutes tacit acceptance.
The Administrator is not obliged to maintain the app's compatibility with all device versions, operating systems, or configurations available on the market. Updates may require installing a recent OS version or modifying the minimum technical requirements.
The Administrator does not access, modify, or distribute users' personal data or content, except when strictly necessary for:
- correcting technical errors or vulnerabilities;
- providing technical support at the user's explicit request;
- complying with a legal obligation, at the request of a competent authority.
The Administrator is obliged to ensure the protection and security of stored data using reasonable technical measures (encryption, secure authentication, periodic backup, access control, etc.). However, the user understands that no IT system can guarantee absolute protection, and the Administrator cannot be held liable for losses caused by unforeseen or uncontrollable events (cyberattacks, hardware failures, connection losses, human errors, etc.).
The Administrator has the right to limit or temporarily suspend accounts that repeatedly violate the rules set in this document or that compromise the security and proper functioning of the Platform. In severe cases, accounts may be permanently deleted without prior notice.
The Administrator is not responsible for:
- content entered by users (data, images, documents, texts, ratings, etc.);
- misinterpretation of data saved in the app;
- loss or damage of stored information due to user error;
- personal, financial, or technical decisions made by the user based on information managed through the app;
- any indirect damages, loss of profits, data, or opportunities resulting from the use of the app.
The Administrator has the right to collect anonymous technical data regarding app usage (e.g., app version, device type, session duration, technical errors) exclusively for statistical analysis and performance optimization. This data does not allow direct identification of users and is processed according to the privacy policy.
The Administrator may send users notifications, alerts, or emails strictly necessary for the app's operation (e.g., password reset, account confirmation, important security updates). Promotional communications will be sent only with the user's explicit consent.
The Administrator has the right to implement or test new functionalities (e.g., premium subscriptions, advanced statistics, automatic backup, third-party service integration, etc.) without being obliged to offer them free to all existing users. Introducing such functionalities does not affect access to the basic app versions.
The Administrator undertakes to treat all user reports and requests seriously and confidentially, respond within a reasonable timeframe, and take appropriate measures depending on the nature of the issue.
If the Administrator decides to terminate the Hikary service, users will be informed at least 30 days in advance via the website or app. During this period, users will be able to export or save their personal data.
The Administrator does not provide or guarantee permanent support, continuous server availability, or non-stop operation of the Platform, but will make all reasonable efforts to maintain over 95% uptime, except during scheduled maintenance.
The Administrator has the right to periodically modify this document, the privacy policy, app interface, or functional structure to comply with current legislation, security requirements, or technological developments. Any modification takes effect upon publication, and continued use of the Platform constitutes acceptance.
The Administrator is not responsible for any economic losses, material or moral damages caused by using the app for purposes other than intended.
The Administrator is obliged to maintain confidentiality and process personal data according to data protection legislation (GDPR and applicable Romanian law), full details available in the Privacy Policy on hikary.ro.
7. Intellectual Property Rights
All content of the Hikary application and the hikary.ro website, including but not limited to elements such as the application name, logo, visual interface, graphic structure, design, texts, images, animations, icons, audio and video files, source code, databases, and all materials published by the Administrator, constitutes the exclusive intellectual property of the Administrator and is protected by Romanian and international copyright and trademark laws.
Users are prohibited from reproducing, distributing, copying, modifying, transmitting, publicly displaying, selling, commercially using, translating, or partially or fully adapting any content belonging to the Hikary application without the Administrator's express written consent. Any attempt to use materials for purposes other than those permitted by this document constitutes a violation of intellectual property rights and may entail civil or criminal liability under applicable law.
The name Hikary, logo, graphic symbols, color combinations, fonts, and visual style associated with the application may constitute unregistered marks protected by usage and are recognized as service identifiers. Any unauthorized use of these elements for commercial or disparaging purposes is prohibited.
The source code, architectural structure of the application, and all software modules developed for the operation of the Hikary platform are protected as intellectual creation works. Decompiling, analyzing, modifying, copying, distributing, or partially or fully reproducing the source code or software elements by any means (reverse engineering, extracting functionalities, cloning, etc.) is strictly prohibited.
By installing the application, users receive a limited, non-exclusive, personal, and non-transferable right to use the Hikary application on their own device, solely for the purpose it was created — managing car information, documents, expenses, ratings, and other related functionalities. This right does not confer any ownership over the application, source code, interface, or its content.
The Administrator reserves the right to update, modify, expand, or restrict design elements, functionality, or content without requiring prior consent from users. All subsequent versions of the application remain the exclusive property of the Administrator, even if provided free of charge to users.
If the user contributes their own content in the application (e.g., car photos, documents, notes, descriptions, ratings, or reviews), they retain ownership of their content but grant the Administrator a non-exclusive, worldwide, free, and perpetual license to use, store, display, and process such content strictly for the operation of the application and the improvement of services. This license does not grant the Administrator the right to sell or redistribute the content for external commercial purposes.
The user guarantees that they own the rights to all materials uploaded to the application or have the legal authorization to use them. Otherwise, the user bears full responsibility for any damages caused to the Administrator or third parties due to copyright violations.
Any content automatically generated by the application (reports, statistics, graphs, estimates, etc.) belongs to the Administrator, and the user has the right to view and use it personally, without redistribution rights.
It is strictly prohibited to use the Hikary brand, logo, name, or any visual identification elements to promote other products, services, or applications without written authorization from the Administrator.
In case of an intellectual property rights violation, the Administrator reserves the right to take legal action, including restricting access to the application, deleting unauthorized content, and initiating legal proceedings to recover potential damages.
Any suggestions, ideas, proposals, or feedback submitted by users regarding the improvement of the Hikary application may be used freely by the Administrator without any financial claim or copyright. By submitting such suggestions, the user acknowledges granting a free and irrevocable license to use them for any purpose related to the development and optimization of the application.
The Administrator fully respects third-party copyrights and undertakes to remove any material that, following a justified complaint, infringes intellectual property rights. Users who identify such violations are encouraged to send a notification via email with relevant evidence to allow verification and removal of the content.
8. Limitation of Liability
The user understands and accepts that the Hikary application and the hikary.ro website are provided 'as is', with all the advantages and limitations inherent to a digital platform. The Administrator makes reasonable efforts to ensure proper functionality, security, and updates of the application, but cannot guarantee continuous operation without interruptions or errors, as it may be influenced by external factors such as device malfunctions, internet connection problems, system errors, Android or iOS platform updates, or cyber attacks.
The Administrator cannot be held liable for:
- loss or damage of data stored by the user in the application;
- financial, technical, or administrative decisions made by the user based on information entered or generated by the application;
- direct, indirect, incidental damages, or economic consequences resulting from the use or inability to use the application;
- temporary service interruptions due to maintenance, software updates, or server technical issues;
- use of the application for illegal purposes, non-compliant with this Agreement or applicable law.
The Administrator does not guarantee the absolute accuracy of information stored or displayed in the application, including expense calculations, statistics, ratings, or automatically generated estimates. This information is provided solely for informational and organizational purposes, and the user must verify and use it responsibly, without relying exclusively on it for critical decisions.
The Hikary platform cannot be considered an official legal, financial, or technical tool and does not replace professional services or legal certifications. The Administrator is not responsible for consequences arising from using the application's data or functionalities for official, legal, or administrative purposes.
The Administrator cannot be held liable for unauthorized actions by third parties, including improper account access, data theft, or cyberattacks on the platform. The user is obliged to protect authentication data and immediately report any suspicious activity.
If the user suffers damages as a result of using the application, these must be considered exceptional and limited, and the Administrator's liability does not exceed the justified value of the service provided. The Administrator is not responsible for indirect damages, loss of profit, data loss, or similar consequences, even if informed of their potential occurrence.
The user accepts that any misuse of the application or breach of these terms and conditions, including account sharing, entering false information, or violating security rules, is done at their own risk.
The Administrator does not guarantee the application's compatibility with all types of devices or operating systems on the market and cannot be held liable for installation, functionality, or performance issues caused by incompatible hardware or software configurations.
In the event of incidents, errors, or temporary interruptions, the Administrator reserves the right to resolve them within reasonable timeframes, but cannot be held responsible for their duration or effects on user data or experience.
The limitations of liability outlined in this chapter apply to the extent permitted by Romanian and European law, without excluding or limiting the rights of users that cannot be waived by contract, according to the law.
9. Changes to Terms and Conditions
The Administrator reserves the right to modify, update, or supplement this Terms and Conditions document at any time to reflect:
- legislative changes or applicable regulations;
- technical updates to the application or the hikary.ro website;
- implementation of new functionalities or services;
- adjustments to internal security, privacy, or platform usage policies;
- user feedback and requests, within the limits of the law.
Changes may be of the following nature:
- minor, when they involve grammatical corrections, interface adjustments, clarifications, or technical details;
- major, when they affect the user's rights and obligations, application functionalities, liability limitations, or other essential aspects of the Agreement.
Any changes to the terms and conditions will be communicated to users via the application, the official website, or electronic notifications, as long as these channels are available. Publishing the new versions constitutes user notification, and continued use of the application after the change date constitutes implicit acceptance of the new terms.
If the user does not agree with the changes, they have the right to stop using the application and request deletion of their account and personal data in accordance with Chapter 4. Any further use of the application after the effective date of changes implies explicit and unconditional acceptance of them.
The Administrator is not obliged to individually notify each user of minor changes but will make reasonable efforts to ensure visibility of major changes and maintain transparency with users.
If the changes to the terms and conditions include the introduction of additional paid services, details regarding fees, payment methods, and service benefits will be clearly communicated before these are activated or used. The user will have the option to accept or refuse these services without being required to give up the basic functionalities of the application.
The Administrator recommends that users periodically review the updated version of the terms and conditions to be informed about their rights, obligations, and the functionalities available within the Hikary application.
Any changes to the terms and conditions take effect immediately upon publication, except in cases where the Administrator specifies a different date for the implementation of changes, which will be expressly mentioned.
The Administrator has the right to retain archives of previous versions of the terms and conditions to document the history of changes and for any clarifications or internal audits.
Changes to the terms and conditions do not retroactively affect the rights legally acquired by users before the modification date, except where applicable law allows this.
10. Final Provisions and Applicable Law

Any other agreements, promises, or verbal statements not included in this document are not considered valid and cannot be invoked as a legal basis.

The Administrator reserves the right to use any data or information obtained through the application for internal analyses, statistics, functionality improvement, and service development, without violating privacy and data protection laws.
The user agrees that by accepting this document, they commit to comply with all provisions regarding rights and obligations, liability limitations, intellectual property, changes to terms, and other chapters presented above.
